Your privacy matters to us. This policy explains what personal data Sparkd collects, why we collect it, how it is used, and your rights as a data subject under the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (nFADP).
1. Who we are
Sparkd is operated by Lopes2Tech, headquartered in Zürich, Switzerland. We provide operations software for cleaning companies across Europe. References to "we", "us", or "our" mean Lopes2Tech / Sparkd.
2. What data we collect
We collect information you provide directly — such as your name, email address, company name, and billing details when you sign up. We also collect usage data (pages visited, features used, session duration) to improve the product, and technical data (IP address, browser type, device) for security and performance purposes.
3. How we use your data
We use your data to provide and improve the Sparkd service, send transactional emails (invoices, job notifications, account alerts), respond to support requests, and comply with legal obligations. We do not sell your data to third parties.
4. Legal basis for processing
We process your personal data on the following legal bases under GDPR Art. 6: (a) Contract — processing is necessary to deliver the Sparkd service you have subscribed to, including account management, job scheduling, and invoicing. (b) Legitimate interest — processing usage and technical data to maintain security, fix bugs, and improve the product. (c) Legal obligation — retaining invoice and financial records as required by Swiss and EU accounting law. Where processing is based on consent (e.g. marketing emails), you may withdraw consent at any time without affecting the lawfulness of prior processing.
5. Data storage and transfers
All data is stored in Switzerland. Switzerland benefits from an EU adequacy decision, meaning your data receives equivalent protection to EU/EEA standards. We do not transfer personal data to countries without an adequate level of data protection. Our infrastructure providers are contractually bound to GDPR and Swiss nFADP-compliant data processing agreements.
6. Third-party sub-processors
We use a limited number of trusted third-party providers to operate the service. Key sub-processors include: Vercel Inc. (hosting and edge delivery, data processed in EU/Switzerland), Resend Inc. (transactional email delivery), and Supabase Inc. (database and authentication infrastructure, EU region). Each provider is bound by a data processing agreement and may only process your data as instructed by us. We will update this section if sub-processors change materially.
7. Your rights under GDPR & nFADP
You have the right to access, correct, or delete your personal data at any time. You may also request data portability or restrict processing. Under the Swiss Federal Act on Data Protection (nFADP), you have equivalent rights including the right to information and the right to object to automated decision-making. 9. Data retention
We retain your account data for as long as your account is active. Upon account deletion, personal data is removed within 30 days, except where retention is required by law (e.g. invoice records required under Swiss and EU accounting regulations).
