Please read these terms carefully before using Sparkd. They set out the rights and obligations of both you (the user) and Lopes2Tech (the operator of Sparkd) when you access or use our service.
By creating an account or using Sparkd, you agree to these Terms of Service. If you are using Sparkd on behalf of a company, you represent that you have authority to bind that company to these terms.
Sparkd provides cloud-based operations software for cleaning companies, including job scheduling, team management, invoicing, expense tracking, and analytics. The service is provided on a subscription basis.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You must notify us immediately at info@sparkd.ch if you suspect unauthorised access.
Subscriptions are billed monthly or annually in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for unused time on a cancelled subscription. We reserve the right to change pricing with 30 days' notice. Continued use of Sparkd after a price change takes effect constitutes acceptance of the new pricing.
New accounts receive a 14-day free trial with full access to the plan features. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using the service. If you do not subscribe, your account will be deactivated and your data will be retained for 30 days, during which you may export it. After 30 days, data is permanently deleted.
You may not use Sparkd to store or transmit illegal content, infringe intellectual property rights, distribute malware, or attempt to gain unauthorised access to any systems. You may not resell or sublicense access to the service without our prior written consent. We reserve the right to suspend or terminate accounts that violate these conditions.
Sparkd and all associated software, designs, trademarks, and content are the exclusive property of Lopes2Tech. Nothing in these terms grants you any right, title, or interest in our intellectual property. You are granted a limited, non-exclusive, non-transferable licence to use the service solely for your internal business operations during the term of your subscription.
You retain ownership of all data you input into Sparkd. We do not claim any rights over your data. Upon account deletion, you may export your data before closure. We will permanently delete your data within 30 days of account closure, except where retention is required by law.
Either party may terminate the subscription at any time. You may cancel through your account settings or by contacting info@sparkd.ch. We may suspend or terminate your account immediately if you breach these terms or fail to pay. Upon termination, your right to access the service ceases. We will retain your data for 30 days to allow export, after which it is permanently deleted.
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the service will be error-free or that defects will be corrected within any specific timeframe.
We target 99.9% monthly uptime. Scheduled maintenance will be communicated at least 48 hours in advance where possible. We are not liable for outages caused by third-party infrastructure providers, force majeure events, or circumstances beyond our reasonable control.
To the maximum extent permitted by law, Sparkd's liability for any claim arising from these terms or use of the service is limited to the amount you paid in the 12 months prior to the claim. We are not liable for indirect, incidental, or consequential damages.
These terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland.
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of Sparkd after that date constitutes acceptance of the updated terms.
